1. Acceptance of Terms

By accessing or using Upperforms ("Service"), operated by Upperforms Inc. ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Upperforms is a software-as-a-service platform that allows users to create, publish, and collect responses to online forms. We provide web and mobile applications for form management and response tracking.

3. Use of the Service

3.1 Eligibility

You must be at least 13 years of age to use the Service. By using Upperforms, you represent and warrant that you meet this requirement.

3.2 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You are responsible for all content you create, publish, or collect through Upperforms.

3.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding data collection, use, and disclosure.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Upperforms Inc. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any content you create using the Service. By publishing forms and collecting responses, you grant us a limited license to process and store that content solely to operate the Service.

6. Prohibited Activities

You agree not to:

  • Use the Service to collect data without respondents' informed consent
  • Create forms designed to deceive, defraud, or harm others
  • Distribute spam or unsolicited communications via forms
  • Attempt to access other users' data without authorization
  • Reverse engineer or attempt to extract source code from the Service
  • Use the Service in any way that violates applicable laws or regulations

7. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Upperforms Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service.

9. Governing Law

These Terms shall be governed by the laws of the Republic of Colombia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bogotá, Colombia.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.
